Appendix B – Terms of Use

The Ministry of Tourism ("MOT") offers the information on this online service/information website ("Service") subject to the terms set out below. The term "User" herein means any person using the database in any way.

Liability

MOT is not responsible for the information published in the database. Said information was provided to MOT by third parties, and therefore it is recommended to verify it with the service providers themselves before making a decision based on the information shown.

It is emphasized that the businesses and sites advertised are not supervised or reviewed by MOT and are not under its responsibility, and MOT therefore is not responsible in any way for the service provided to the visitor, including the quality and nature of the physical facilities or the service, the prices charged, the visitor's satisfaction, etc.

MOT shall not be held liable for any damage caused to User or to any visitor due to the use of the database and/or while visiting a tourism business that appears in the database.

The Ministry shall not be held responsible and/or liable whatsoever for any direct and/or indirect physical and/or financial damage/s suffered by the visitor/s during their visit on one (or more) of the sites listed herein.  

The information published in the database informs of the existence per se of the businesses (attractions, accommodation, events, etc.) and is not in any way a specific recommendation to use a particular business. Full responsibility for the service is imposed on the service provider.

MOT shall not be held liable for the suitability of the Service to User's needs. Furthermore, MOT shall not be held liable for errors or mistakes in the material published in the Service.

User alone is responsible for the way in which he/she uses the Service.

MOT shall not be held liable for any damage caused to User or to any third party as a direct or indirect result of using the Service, including damage caused due to the use of software applications downloaded directly through the Service or activated as a result of the use of the Service, including Java, JavaScript and ActiveX.

MOT shall not be held liable for any content posted on the Site by surfers (e.g. opinions).

For purposes of this section, "Ministry of Tourism" includes its employees and representatives.

Links

This Service contains links to other sites. The following conditions apply to the use of these links, without derogating from the other conditions in these Terms of Use. The links are provided solely for the convenience of User. Regarding links to external sites which are not owned by the State of Israel ("third party sites"), unless otherwise stipulated on this Site, no legal or commercial relationship exists between MOT and the owners of third party sites, and MOT has no control over or right to material found on those sites.

The State of Israel is not responsible for the content of third party sites and/or for information on products or services offered on them, whether commercial or noncommercial, including as to their nature or quality. It is recommended to check the information with the service providers or with another relevant party. Links to third party sites may not be construed as endorsement, approval, recommendation or favoring by the State of Israel or MOT of those linked-to sites, including documents and other material found on them, of the operators of said sites and of the products or services presented and/or offered on them. At the time each link was included in this Service, the information contained on the linked-to site was found to be compatible with the purposes of the Service and the link itself was functional. However, it is possible that with the passage of time changes have occurred in the linked-to site. If User feels that the linked-to site or material is inappropriate, or if User finds that the link is no longer operational, he/she is requested to inform MOT via email at the address: webmater@tourim.gov.il.

Surfer Content

The Service allows surfers to post opinions about the tourism businesses in the database.

It is forbidden to post in the database inappropriate or unseemly opinions, including opinions with offensive, racist, sexually explicit and such like content. MOT is entitled to delete such inappropriate opinions, at its sole discretion.

Copyright

Under copyright law in Israel and in accordance with international treaties, copyright in MOT publications, including those published in this Service, belongs to the State of Israel. Said copyright applies, inter alia, to text, pictures, drawings, maps, sound clips, video clips, graphics and software applications ("protected material"), unless explicitly stated that the copyright in the protected material belongs to another party.

User may make "fair use" of the protected material as set out under law. Fair use includes quoting from the protected material in a reasonable manner. When quoting from protected material, User must attribute the source of the quotation, whether it is MOT or another party. User may not distort, mutilate or otherwise modify the material, and may not do any other act which impairs the value of the protected material, in a manner which could be prejudicial to the honor or reputation of the owner of the copyright therein.

Material published in the database which is not owned by MOT, was provided to MOT for its use by the third party to whom the information relates, and said third party gave its consent to the publication of the protected work.

Subject to copyright law, User may not copy, redistribute, retransmit or publish protected material, without the prior written consent of MOT.

Confidentiality

Personal information provided to MOT through this Service shall be kept confidential in accordance with the provisions of the Protection of Privacy Law, 5761-1981.

Official Publications of the State of Israel

In the event of a conflict or inconsistency between material published in the Service and material appearing in official written publications of the State of Israel, only the material contained in such official publications shall be deemed correct.
